Wage & Hour

 

  • Settled: Experienced tradesman provided labor - his own and others'- at the request of a subcontractor on a public works project. The first week was paid for. The second week, the subcontractor did not appear, and tradesman provided the work directly, without contract and without his own license. Contractor paid subcontractors, but not the un-contracted, unlicensed laborers. Tradesman sued to recover for all unpaid labor, as a contractor not as a laborer.


  • Resolution of PAGA claims of undocumented workers, requiring workers to clock in and out under different names to avoid paying overtime at a restaurant. Mediation conducted using Spanish.


  • Resolution of claims of failure to pay prevailing wage, clocking in on job site/ waiting periods claims at a plumbing company. Mediation conducted using Spanish.


  • Resolution of claims of failure to pay minimum wage, earned wages, rest periods and dispute over classification as management/ exempt status at a restaurant.


  • Resolution of uncertified potential class action for failure to pay earned wages, prevailing wage claims, denial of rest and meal periods and overtime at a restaurant. Mediation conducted using Spanish.


  • Resolution of claims by caregivers under the Caregiver’s Rights statute, regarding overtime and meal breaks. In one interesting case, caregiver resided in the elder’s family’s home, brought in her own family to live there as well, and charged all her family’s food to the elder’s credit card. Within a week of the elder’s death, the caregiver sued the estate for failure to pay overtime, or provide rest and meal breaks. In another case, the family paid the caregiver minimum wage for 40 hours a week, but required that she be on call every day and all night.
